General terms and conditions of courses, lectures and webinars provided by Petr Tmej at www.AOStrading.net, www.AOStrading.cz/en portals (hereinafter referred to as ”Terms”).
By submitting the order of a webinar, online course, lecture, webinar or event, the User agrees to the following Terms and agrees to abide by the rules therein.
1. General Provisions
1.1. Courses, lectures, webinars and events are organized by Petr Tmej, ID: 03557065, VAT: CZ8412035555, Address: Rehorova 2877/41, 130 00, Praha 3. Petr Tmej is registered in the Trade Register by the Trade Licencing Office in Prague (UMC Prague 3), file number UMCP3104565/2014 (hereinafter referred to as ”Provider”). The stated prices are final. The Provider is the VAT registered.
1.2. The “User” is a natural or legal person who paid for order of course, lecture, webinar or event provided by the Provider or for buying a licence for software use.
1.3. The price of the course is divided into 2 categories:
34% of price to live webinar,
66% of price to immediate access to recorded webinar.
2. Subject of Service
1.2. The subject of service is the Users’ rights to participate in courses (group or individual), lectures, webinars and events or, in case of online courses, the access to data video streaming of pre-recorded video lessons stored on the Provider’s server (hereinafter referred to as “online course”) in a scope as described in article 3.1.
The subject of service can also be a purchase of a license to use software produced by third parties.
2.2. Videos provided within the online course are only available in a form of online streaming data from the server AOStrading.cz. The high-speed Internet connection is a necessary prerequisite for accessing the online course. It is not possible to download and save the online course to the User’s computer for later offline viewing.
2.3. The online course can only be viewed on devices supporting Adobe Flash. It is not possible to guarantee the possibility to view the online courses on devices that do not support Adobe Flash (e.g. Apple iPad).
2.4. The Provider reserves the right to modify the course content and update it at any time provided that the topic of the online course will remain the same. In the case of modification or update of the online course, the User has no right to compensation (financial or non-financial) or refund.
2.5. In case of class courses, lectures, webinars and events (hereinafter referred to as “the training event “) the subject of service is always only the participation in the training event at the date and time specified in the order form. The subject of the service does not include the right for additional consultation or participation in other training events organized by the Provider.
3. Scope of Service
3.1. In case of the training event, by paying the price of the training event, the User is entitled to attend the training event at the date and time as specified in the order form.
3.2. In case of tuition payments, the due date is 5 days from receiving the request for payment (sent by e-mail within one day from ordering the course), but no later than 5 days prior to the course date. In case of non-payment within the due date, the Provider reserves the right, but not the obligation, to cancel the User’s order and to make the training event seat available to another candidate.
3.3. In case of an online course, by paying the price of the course, the User is entitled to access the ordered online course for 365 calendar days from the first access date which is defined by the Provider as the date of course payment confirmation. The Provider will notify the User about the first access date by e-mail. For accessing the lessons, the User will receive the Username and Password by email. Afterwards User will have to login on this page: http://aostrading.cz/en/wp-login.php. The User will receive the email with the link on the page where the lessons are available.
3.2. The ordered service expires after the deadline defined in 3.1., irrespective of whether the User did or did not use the service he paid for. At the User’s request, the Provider may at his discretion extend the deadline defined in 3.1. for free. However, there is no legal claim for such an extension. The request for extension of service with a brief justification should be sent electronically to the e-mail address firstname.lastname@example.org
4. Rights and Obligations of the User
4.1. In order to purchase an online course, training event or a software licence, the User must register directly on the site of the course.
4.2. The User has the right to get access to ordered and paid training event in a time and scope defined in Article 3.3.
4.3. The User commits to conform to the rules set out in Article 6 – Copyright Protection and Intelectual Property Rights Protection.
4.4. The User taking part in the training event is obliged to guard all of his personal belongings during the course and not to leave any of his assets unattended (especially during the coffee or lunch breaks). The Provider cannot be held liable for any losses (e.g. mobile phones, laptops or cash).
5. Rights and Obligations of the Provider
5.1. The User grants the Provider the right to send to the User commercial communications from the Provider about his and his business partners’ services and news via newsletters and e-mail communication to the e-mail address of the User. The Provider is obliged to cease sending such communications to the User in case that the User requests for it via e-mail or if he unsubscribes from the list of Users.
5.2. In case of training events, the Provider reserves the right to change tutor, date and venue or to cancel the training event for organizational and operational reasons. Any such changes will be communicated to participants by phone or e-mail.
5.3. Unless explicitly stated otherwise, only a basic refreshment such as coffee and water is provided during the training events. Unless explicitly stated otherwise, lunch is not included in a standard tuition and therefore will not be provided by the Provider.
5.4. The Provider has the right to take photographs, audio and video recordings of the training event and the participants. He also has the right to publish these photographs and recordings on Facebook, other social networks, on www.AOStrading.net, www.AOStrading.cz or www.AOStrading.cz/en or via third parties. The User agrees with publishing of such photographs and recordings, even those which show the person of the User.
5.5. The Provider is obliged to set the User access rights to the ordered and paid online course within 3 working days after receipt of full payment of the course fee on the Provider’s bank account.
5.6. The Provider has the right to prematurely terminate the User’s access to the online course without compensation, provided that the User breached the Article 7 of these Terms.
5.7. The Provider has the right to terminate the User’s access to online courses without compensation in following cases:
- Any video which is the part of the online course is played by the User more than 50 times.
- Any video which is the part of the online course is streamed within five minutes under a particular username and password to two or more different IP addresses.
- The third-party sites published a video from the online course of the Provider containing personalized identification elements of the User.
- The Provider discovers attempts of the User to technically manipulate the mode of playback of videos which are the part of the online course.
- Login from more than 4 IP addresses.
5.5. In case of unavailability of the online course in the period defined in Article 3.1., the Provider is obliged to extend the User access time to the online course for the time equivalent to the period during which the course was inaccessible to the User. Except for usage time compensation, the User is not entitled for any financial compensation or refund in case of server failure resulting in the online course unavailability.
6. Copyright Protection and Intellectual Property Rights Protection (IPR)
6.1. The training events are the copyrighted work of the Provider and the User has not right to distribute the training event content by electronic or other means. The User has the right to use the training event and online course materials only for his private use.
6.2. The User agrees that any video played and watched as a part of the online or webinar course is personalized and marked with the User name. There are several other personalized features embedded in the video lessons which are the part of the online course purchased by the User. All of these elements are an integral part of the online course. In case of unauthorized distribution of the online or webinar course content outside, it will be used in the court proceedings as a justification of the claimed damages caused by the violation of the copyright law and IPR.
6.3. The User commits not to download capture or record videos from the online or webinar courses on his hard drive or other offline or online media used for storing digital or other data. Likewise, the User commits no to record audio or video records of the training events. All such or similar activities are in contradiction to will of the Provider as well as these Terms.
6.4. Copyright protection also applies to any electronic/digital or analogue materials provided to the user as a part of training events or online courses. Such materials are only provided to the User for his private educational purposes and it is forbidden to distribute them to third parties.
6.5. The User is not allowed to capture any audio or video recordings during the training events as it would cause the breach of copyright and IPR protection.
6.6. By paying the online course tuition, the User agrees with the fact that the access and viewing of the online course is not anonymous. The Provider has the right to track and record the IP address of each access to online courses along with the login name that is used for video playback. The access and login to online courses is limited to 5 IP adresses. After exceeding this limit of IP addresses, the Provider has the right to block the User’s access to the online course due to suspicion of unauthorised use of login data of the User.
8. Payment Terms
8.1. The training event tuition is always due no later than 5 days from the date of the payment request sent by the Provider by e-mail after ordering the training event or online course. In case of non-payment of the tuition within the due date, the Provider reserves the right, but not the obligation, to cancel the order and to make the seat available for another candidate.
9. Cancellation Policy
9.1. In case of training events, the cancellation fee is 20% of the tuition if the User cancels his participation up to 7 days prior to the training event date. The cancellation fee is 100% of the tuition if the User cancels his training event participation 7 or less days prior to the training event date. The Provider has to be informed about the cancellation in writing by e-mail to email@example.com. The Provider has the right to charge the cancellation fee even in case that the User has not yet paid the training event tuition at the time of cancelling his order. Cancellation is valid only if confirmed by the Provider! In case of cancellation 7 or less days before the training event date, the tuition fee is not refundable and the User is not entitled to take part in another training event as a form of compensation. However, the paid tuition is transferable – the User may send a substitute participant to take part at the ordered training event.
9.2. In case of online course the cancellation fee is 100% of the price of the course. The reason is that once the access to watch the online course is provided the User agrees that the service was fully provided and User does not have right to any refund.
10. Complaints Conditions
10.1. Any changes in training events provided by the Provider will be communicated to Users by phone or e-mail. In case of organizational changes as defined in Article 5.6., the User is entitled to 100% tuition refund, provided that he announced cancellation of his participation to the Provider within 3 days after receiving information about the organizational change.
11.1. Discount programs cannot be combined or aggregated. In case of simultaneous participation in several discount programs, the User is only entitled to one of the discounts of his choice. The discount code that the User wishes to apply for must be entered in the relevant field of the order form when ordering the training event or online course. Discounts are not transferable to other participants.
12. Final Provisions
12.1. In accordance with Act No. 101/2000 Coll. on the protection of personal data, the User agrees that the Provider stores in his database data entered by the User when ordering the training event or online course. The Provider is authorized to process such data for the purposes of commercial relations with the User and for sending him regular business communication and newsletters. This consent is granted for an unlimited period, unless the law provides otherwise. The User has the right at any time to unsubscribe from receiving such commercial messages.
12.2. In case that individual provisions of these Terms get invalid, the remaining provisions remain in force. The resulting gap will be substituted by a corresponding adjustment of the purpose and meaning of these Terms.
12.3. Any information provided in training events or online courses organized by the Provider is intended solely for educational purposes related to exchange trading and in no case serves as a particular investment or trading advice. In case there are particular financial instruments, trading strategies, underlying assets or derivatives mentioned on www.AOStrading.cz/en or www.AOStrading.net, training events, educational materials, downloads, presentations, videos or online courses, it is always and solely for educational purposes. The Provider, authors of training courses, educational materials, articles, documents and videos or lecturers are in no case responsible for particular trading decisions of individual traders, Users of Provider’s products or services or participants of the Provider’s training events.
